Welcome to is-by.pro ("the Platform", "we", "us", or "our"), operated by HyperSpire Foundation. By accessing or using this Platform, you ("User") agree to the following Terms of Service ("Terms"). If you do not agree, do not use the Platform.

1. User Rights and Freedoms

We believe in the foundational rights of our users. Consistent with the principles of the United States Bill of Rights and applicable law:

Freedom of Expression. Users have the right to express their views and ideas. The Platform is committed to minimizing viewpoint-based censorship. Content is only removed when it violates these Terms or applicable law.
Privacy. Users have a reasonable expectation of privacy. We will not sell, rent, or share your personal data with third parties for advertising purposes. See our Privacy Policy for details.
Due Process. Users whose accounts are suspended or content is removed will be notified and provided a reasonable opportunity to appeal, except where prohibited by law or where immediate action is required to protect the safety of others.
No Unlawful Discrimination. We do not discriminate against users on the basis of race, religion, national origin, sex, disability, or other protected characteristics under applicable law.
Transparency. We will be transparent about changes to these Terms and will provide notice before material changes take effect.

2. User Responsibilities and Conduct

By using the Platform, you agree that you will not post, transmit, or share content that:

Violates any applicable federal, state, or local law or regulation;
Is defamatory, fraudulent, or intentionally misleading;
Constitutes harassment, stalking, threats, or incitement to violence against any individual or group;
Infringes on the intellectual property rights (copyright, trademark, patent) of any third party;
Contains malware, spyware, viruses, or other harmful code;
Constitutes spam, unsolicited advertising, or phishing;
Violates the privacy rights of others, including posting personally identifiable information without consent ("doxxing");
Depicts or promotes child sexual abuse material (CSAM) — any such content will be reported to the NCMEC and relevant law enforcement immediately.

You are solely responsible for all content you post. You represent that you have all necessary rights, licenses, and permissions for any content you submit.

3. Limitation of Liability for User-Generated Content

is-by.pro is an interactive computer service provider. Consistent with Section 230 of the Communications Decency Act (47 U.S.C. § 230), the Platform is not the publisher or speaker of content created by users. The Platform is not liable for:

Any user-generated content posted, shared, or transmitted by users;
Any harm, loss, or damage arising from your reliance on user-generated content;
Any third-party claims arising from content you post on the Platform.

You agree to indemnify, defend, and hold harmless is-by.pro, HyperSpire Foundation, and their respective officers, directors, employees, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit to the Platform.

4. Content Ownership and License

You retain ownership of all content you post on the Platform. By posting content, you grant is-by.pro a non-exclusive, royalty-free, worldwide license to display, reproduce, and distribute your content solely for the purpose of operating and improving the Platform. This license terminates when your content is deleted.

You may delete your content at any time. Deleted content will be removed from public display promptly, though residual copies may persist in backups for a limited period.

5. Account Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms. We will make reasonable efforts to notify you prior to permanent termination except where immediate action is necessary. You may delete your own account at any time.

6. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

7. Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL IS-BY.PRO OR HYPERSPIRE FOUNDATION BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF $50 OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

8. Governing Law and Disputes

These Terms are governed by the laws of the State of [YOUR STATE], without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Platform shall be resolved by binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction. 9. Digital Millennium Copyright Act (DMCA)

We respect intellectual property rights. If you believe content on the Platform infringes your copyright, please send a DMCA takedown notice to:

10. Changes to These Terms

We may update these Terms from time to time. We will provide at least 30 days' notice of material changes by posting a notice on the Platform. Continued use of the Platform after the effective date of any change constitutes your acceptance of the new Terms.
